Civil Process Unit
The duties of the Civil Process Unit include executing Civil Summons and Complaints, Orders to Show Cause, State Grand Jury Notifications, Subpoenas and Writs, Inclusive of Replevin, Executions and Possessions. The Civil Process Division also serves legal documents for the Family Part of the Superior Court including Domestic Violence Orders, Child Support Orders and Notice of Hearings, each of which must be served personally. This unit also acts as the primary authority for the posting of Sheriff Sale Notices, wherein properties are posted for foreclosure sales as well as Sheriff Sales.
Summons and Complaints
Serving Summons and Complaints is the primary responsibility of this unit. This task involves properly serving legal documents involving ongoing or pending civil legal actions. In 2002 alone, the Summons and Complaints Unit recovered more than a quarter of a million dollars for the County of Bergen.
Domestic Violence
The Domestic Violence Unit of the Civil Process Division handles the serving of Notice of Hearings in the Family Part of the Superior Court pertaining to both domestic violence and child support matters. Orders are served before the scheduled hearing date, normally within 10 days of issuance. Additionally, the unit's involvement in Temporary or Final Restraining Orders at times requires that it seize weapons from individuals.
